1. Acceptance of Terms

By accessing, browsing, or using the website apnaworkplace.in (the "Website") and/or engaging any services provided by ApnaWorkPlace Solutions ("Company," "we," "our," or "us"), you ("Client," "User," or "you") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree with any part of these Terms, you must not use our Website or services.

Important: These Terms constitute a legally binding agreement between you and ApnaWorkPlace. Please read them carefully before using our services.

2. Description of Services

ApnaWorkPlace provides professional business solutions including, but not limited to:

Data Entry Services

Manual and automated data entry with 99.99% accuracy guarantee.

Data Conversion Services

Format conversion including PDF, Word, ePUB, XML, HTML, and more.

Web Development

Custom website and web application development with modern technologies.

Web Scraping

Automated and customized data extraction from web sources.

Content & Book Writing

Professional content creation, ghostwriting, editing, and publishing support.

Web Application Development

Full-stack web applications with robust backend and scalable architecture.

The specific scope, deliverables, timelines, and pricing for each project will be agreed upon in a separate Service Agreement or Statement of Work (SOW) between the Company and the Client.

3. User Account

3.1 Account Registration

To access certain features and services, you may be required to create an account on our platform at login.apnaworkplace.in. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate and current.
  • Keep your login credentials confidential and secure.
  • Notify us immediately of any unauthorized use of your account.

3.2 Account Responsibility

You are solely responsible for all activities that occur under your account. ApnaWorkPlace will not be liable for any loss or damage arising from your failure to maintain the confidentiality of your account credentials.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or for any other reason at our sole discretion.

4. User Obligations

By using our Website and services, you agree to:

  • Lawful Use: Use our services only for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations.
  • Accurate Information: Provide accurate, complete, and truthful information in all interactions with us.
  • Timely Communication: Respond to queries and provide necessary materials/information in a timely manner to avoid project delays.
  • Respect Intellectual Property: Not infringe upon or violate the intellectual property rights of ApnaWorkPlace or any third party.
  • No Harmful Activities: Not engage in activities that could harm, disable, overburden, or impair our Website, servers, or networks.
  • No Unauthorized Access: Not attempt to gain unauthorized access to any part of our Website, systems, or networks.
  • No Reverse Engineering: Not reverse engineer, decompile, or disassemble any technology or software used in our services.

5. Service Delivery

5.1 Project Timelines

We strive to deliver all projects within the agreed-upon timelines as specified in the Service Agreement. However, delivery timelines may be affected by:

  • Complexity and volume of the project.
  • Timely provision of required materials and information by the Client.
  • Changes in project scope requested by the Client.
  • Unforeseen technical challenges or force majeure events.

5.2 Quality Standards

ApnaWorkPlace is committed to delivering work that meets the highest quality standards. Our quality assurance process includes:

  • Multi-level quality checks before final delivery.
  • 99.99% accuracy guarantee for data entry and conversion services.
  • Code review and testing for web development projects.
  • Plagiarism checks for all content writing deliverables.

5.3 Delivery Method

Completed work will be delivered through mutually agreed channels, which may include email, cloud storage links (Google Drive, Dropbox, etc.), FTP, or direct platform delivery. The risk and ownership of deliverables transfer to the Client upon successful delivery and acceptance.

6. Payment Terms

6.1 Pricing

Service pricing is determined based on the project scope and will be specified in the Service Agreement or quotation provided to the Client. All prices are quoted in Indian Rupees (INR) unless otherwise stated.

6.2 Payment Schedule

  • A non-refundable advance payment of 25-50% of the total project cost may be required before work commences.
  • Milestone-based payments may be applicable for larger projects.
  • Final payment is due upon completion and delivery of the project.
  • Invoices must be paid within 15 days of the invoice date unless otherwise agreed.

6.3 Payment Methods

We accept payments through the following methods:

  • Bank Transfer (NEFT/IMPS/RTGS)
  • UPI (Google Pay, PhonePe, Paytm, etc.)
  • Online Payment Gateways
  • International Wire Transfer (for overseas clients)

6.4 Late Payments

Late payments may incur a penalty of 1.5% per month on the outstanding balance. ApnaWorkPlace reserves the right to suspend ongoing work or withhold deliverables if payments are overdue by more than 30 days.

6.5 Refund Policy

Refunds are handled on a case-by-case basis. Advance payments are generally non-refundable. If we fail to deliver work that meets the agreed specifications after reasonable revision attempts, a partial or full refund may be issued at our discretion.

7. Intellectual Property

7.1 Client's Intellectual Property

All materials, data, and content provided by the Client remain the exclusive property of the Client. We will use such materials solely for the purpose of performing the agreed services.

7.2 ApnaWorkPlace's Intellectual Property

All proprietary tools, methodologies, processes, templates, frameworks, and technologies developed by ApnaWorkPlace remain the exclusive intellectual property of the Company. The Client is granted a non-exclusive, non-transferable license to use the deliverables for their intended purpose only.

7.3 Transfer of Rights

Upon full payment, the intellectual property rights in the final deliverables (excluding our proprietary tools and frameworks) will transfer to the Client, unless otherwise specified in the Service Agreement.

7.4 Portfolio Usage

Unless specifically prohibited by the Client in writing, ApnaWorkPlace reserves the right to showcase completed projects in our portfolio and marketing materials, without disclosing confidential information.

8. Confidentiality

We understand the importance of confidentiality and are committed to protecting your sensitive information:

  • Non-Disclosure: All client data, project details, and proprietary information shared with us will be treated as strictly confidential.
  • Employee NDAs: All team members working on client projects are bound by Non-Disclosure Agreements (NDAs).
  • Secure Handling: Confidential data is handled through secure channels and access-controlled systems.
  • Data Deletion: Upon project completion (or upon client request), all client data will be securely deleted from our systems within 30 days.
  • Custom NDA: Clients may request a custom NDA before project commencement, which we will gladly accommodate.

9. Warranty & Revisions

9.1 Service Warranty

ApnaWorkPlace warrants that all services will be performed in a professional and workmanlike manner, consistent with industry standards. We guarantee:

  • 99.99% accuracy for data entry and conversion services.
  • Original, plagiarism-free content for writing services.
  • Functional and responsive code for web development services.

9.2 Revision Policy

  • Clients are entitled to up to 3 rounds of free revisions within 15 days of initial delivery.
  • Revisions must fall within the original project scope. Changes to scope may incur additional charges.
  • Additional revisions beyond the free rounds may be charged at standard hourly rates.

9.3 Disclaimer

Except as expressly stated in these Terms, all services are provided "as is" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • ApnaWorkPlace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of our services.
  • Our total liability for any claims arising under these Terms shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
  • We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet disruptions, government actions, or pandemics.

11. Termination

11.1 Termination by Client

The Client may terminate a service engagement at any time by providing 7 days written notice to ApnaWorkPlace. In such case:

  • The Client will be billed for all work completed up to the date of termination.
  • Advance payments made are non-refundable.
  • Any materials or deliverables created up to the termination date will be provided to the Client upon full payment.

11.2 Termination by ApnaWorkPlace

We may terminate or suspend a service engagement immediately if:

  • The Client breaches any provision of these Terms.
  • Payment is overdue by more than 30 days.
  • The Client engages in illegal, unethical, or harmful activities.
  • Continued service would expose ApnaWorkPlace to legal or reputational risk.

12. Indemnification

You agree to indemnify, defend, and hold harmless ApnaWorkPlace, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to:

  • Your use of our Website or services.
  • Your violation of these Terms.
  • Your violation of any applicable laws or third-party rights.
  • Content or materials provided by you that infringe upon third-party intellectual property rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal proceedings related to these Terms shall be subject to the exclusive jurisdiction of the courts in India.

14. Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms:

  • Step 1 — Negotiation: The parties shall first attempt to resolve the dispute through good-faith negotiation within 15 days.
  • Step 2 — Mediation: If negotiation fails, the parties agree to submit the dispute to mediation before a mutually agreed-upon mediator.
  • Step 3 — Arbitration: If mediation fails, the dispute shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.
  • Step 4 — Litigation: Either party may seek injunctive relief or other equitable remedies from a court of competent jurisdiction at any time.

15. Force Majeure

Neither party shall be held liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, hurricanes, etc.)
  • Epidemics, pandemics, or public health emergencies
  • War, terrorism, or civil unrest
  • Government actions, sanctions, or embargoes
  • Power failures, internet outages, or telecommunications disruptions
  • Strikes, lockouts, or labor disputes

The affected party shall notify the other party of the force majeure event as soon as reasonably practicable and make commercially reasonable efforts to resume performance.

16. Modifications to Terms

ApnaWorkPlace reserves the right to modify, update, or revise these Terms at any time. We will provide notice of material changes by:

  • Updating the "Last Updated" date at the top of this page.
  • Posting a prominent notice on our Website.
  • Sending an email notification to registered users (for significant changes).

Your continued use of our Website and services after such modifications constitutes your acceptance of the revised Terms. If you do not agree with the modified Terms, you must discontinue using our services.
